Whether contempt petition can be filed in such cases?

Sir,
Kindly refer to my previous query in which CAT has issued directions to organisation produce the original records but the respondent counsel has not been furnishing the same despite of several adjourmnets given by the court and the court has given 2 times final opprtunity for furnishing the record..In the second last hearing he has informed the court that the records has been misplaced from the office and Cta has given another opprtunity to them failing which adminsitation action shall be imposed..In the last hearing the leraned counsel did not apper..
What I am saying that he has already taken 7-8 adjournments, and hon'ble court has been issuing the warnings but not action has been taken so far..In that case whether contempt petition can be filed for non complying the directions of the CAT??

Dear Mr. Raman,
The matter is still before the CAT. There is no 'contempt' so far.
Please have patience. Even if it has already taken 7-8 adjournments, and even if there is going to be some more adjournments, you have to maintain patience. Court matters do take time.

It is unfair on your part to start new thread and wasting previous time of the experts (spared charitably) to hunt for your previous thread.


In case the record is not produced the CAT has powers to call for personal appearance of the Head.

You have to wait. Every fraudster has a right to adopt gimmicks to avoid law till he is actually caught.

i agree with anirudh and sudhir kumar . no contempt of court has been committed .

you cna request the court that since 8 adjournments have been taken last chance be granted to respondents on payment of cots , no further adjournments be granted .

have patience . if original records are not produced court will draw adverse inference against respondents
