Regarding section 382

(Querist) 26 February 2012 This query is : Resolved 
.in case (under 382.34). in fir have name of person who is not criminal and court give bail to person.. and after bail person filed renquiry. then police enquiry state that a person is not a criminal . ssp mark file to legel da. then district attorney give comment fill her name in 2nd column of chalan. an produce chalan in court. can experts tell dis person is now accused or not. if yes den what is the benifit of enquiry

That person is not an accused now and has been shown as a witness. The enquiry has already been completed and subsequent report is based upon that enquiry.

One thing has been left. This person shall have to declared as discharged by concerned court only then he shall be treated as 'not an accused'

The person can still be allayed as an accused by the court on application by complainant or witness after the evidence is complete.

That person is an accused till he is either acquitted or discharged by the court.

There are no quick fire ways.....

The case has to progress its own speed and then only acquittal would happen.

The accused need to fight the case in its merit and convince the court of his innocense to get acquitted.
It cannot be done in one go.
