Dear Experts

A minor girl was alleged to be raped by some one and thrown on railway track after cutting her legs and hands. People expressing lot of doubts i.e, she had been raped and murdered as she went to cinema in the evening and her mother says she said that she is going to tution and mother not supporting police. One part (amputated hand ) was found on the upstairs of a nearby house. Railway Police examined the scene and treated it as a train accident. But its not fact and police was influenced by the locality persons. girl placed her school bag in her friends house. Her death is mistry.
In such case Police did not utilised the dog squad and clues team. It is recommended or not? In which situation Police will use clues team and dog squad?
Police did not observed the relations, friends, her activities of the girl and her mother, it is correct in investigation?
What steps are necessary to find the accused in such case.?
How the police can be put into motion for proper investigation?

The de facto complainant if becomes dissatisfied with the course of investigation may apply for its re investigation by CID or CBI.

The lower court may direct investigation by CID but for CBI investigation intervention of High Court is needed.

Any person aggrieved can apply for crime branch for investigation.

CBI MAY NOT DO IT, UNLESS PRESSURIZED BY TOP POLITICIANS OR HC.

Police are managed by interested parties,
we never know the facts!!.

Approach the High Court for transfer of investigation to a different wing CBCID or CBI. At least seek the transfer of investigation to the different I/O.

Though broadly concurring with what seniors have said - the court would at first be reluctant to order CBI enquiry - if the investigation is not yet complete approach the concerned local magistrate u/s 156(3) - wherein the magistrate is empowered to monitor the investigation - so that it is carried on in a bona fide and fair manner. If that fails to yield the desired results, as aforesaid - HC can order CBI investigation u/s 482 CrpC
