Querist : Anonymous (Querist) 11 January 2012 This query is : Resolved
Dear Sirs,
I have taken the flat on rental basis in Jan.2009. The agreement is not registered, it was done on Rs 200 stamper paper. Now the owner is not refunding the full amount of deposit to me. Keys of the flat are with me. He has cut the lock and taken the possession of his flat. All the rent is paid by cheque only. In 2009,the rent was Rs.8000/- when the agreement was made. The agreement was not made for the year 2010 & 2011. The rent was Rs.9000 in 2010 and Rs.10,000/- in 2011. Sir, How I will get my deposit of Rs.50,000/-.

you have to file summary suit for refund of money . libaility for registration is that of licensor . since you have proof that rentals have been paid on time issue legal notice to licensor .

If the landlord has taken forceful possession of the tenanted property then you can file criminal case of hurt, criminal intimidation and house trespass again him.
No one even the owner of a property can not oust the tenant without the due process of law.
The landlord has done a very serious offence.
This would yield expeditious result to get back your security.

I fully endorse the views of Barman. You can pray for the restoration of your possession over the property as the landlord has forcibly evicted you.
