Gift settlement deed

My grandfather purchased a property on his name and other two of sons.They together built a 3 storeys apartment.Few years back one of his elder son passes away.Now my grandfather make a decision to give one of the flat as a gift to my mom but the question arises that who shall stand as legal heir of his elder son as he passed away.Who shall sign on the gift settlement deed on the behalf of his elder son..?

the said property owner for one son so his legal heirs will become owner, by way of intestate.

The wife, mother & all children of deceased shall be his legal heirs so all of them have to sign on behalf of deceased on the proposed settlement deed.
