Finalisation of tender in bsnl

In one tender 4 bidders participated out of that 3 have quoted equal rates and 4th bidder quoted lowest rate.
1. Whether it is a case of cartel formation?
2 Can we counter offer/allot work to these three bidders at lowest bidder rate?

why not allot work to 4th bidder who has quoted the lowest rate . ? ife he meets the requirements of the contract as to technical qulaifications , work experience , financial soundness etc

Definitely, it is cartel case. Rather, I believe that the three bidders have tried to pool their bid in favour of the fourth bidder for some consideration. Either those bidders are a proxy, not competitive bidders, just to hoodwink the tendering process of BSNL to fill in the blank of the required minimum number of bidders, OR the other bidders can get the same favour in turn from the lowest bidder in some other bids.

If you think that the prices offered by the lowest bidder are reasonable, you may better negotiate with the three other bidders to agree for the lowest rate. That way the work can be expedited early also.

But, if they have pooled just in favour of the 4th bidder, I am sure, they won't agree to reduce their rates, as they would be unwilling bidders or proxy bidders for the job. In that case I would have advised for calling of fresh tenders.

Dear Friend,
From the limited information shared on this platform , I wonder why do not you go ahead in allotting the work in favour of the lowest tenderer fulfilling the eligibility criterion.
In case you have any reliable information casting doubt on the capability or genuineness of such bidder, you can cause an inquiry at your level, record your findings and go ahead for floating a Re tender/ fresh tender in the interest of your organisation.

Here some one feels pleasure in dumping his cart in between just to derail the main issue merely to add scores to his credit even when he does not understand the ABC of the problem.
