Our Company at Delhi has to furnish a Bank Guarantee to a Mumbai based Company.
What is the applicable Stamp duty to be paid?

Stamp Duty as per Mumbai @ amount of Bank Guarantee. Bank guarantee will attract stamp duty as per Mumbai stamp act 1958

Where is Bank situated ? Delhi or Mumbai?

The Bank is situated at New Delhi.

Based on the fact that the issuing Bank is located at Delhi,the stamp duty rates of Delhi are applicable.Accordingly,the Bank Guarantee can be executed on a Stamp Paper of Rs. 100.

Please confirm that a Bank Guarantee issued by a Delhi Bank shall entail a Stamp Duty of Rs. 100,irrespective of value.

Stamp duty would be payable according to stamp act as applicable to delhi state.

I have no idea about amount of stamp duty at delhi, so please check with local lawyer.

The stamp duty is charged by state in which the agreement is executed and as it differs from state to state not every body here can tell you.Mr. shah n me are from UP.
