Share from my father

Dear Sir,

My father and his two brothers living in Panipat in our agriculture land.This property was actually on my grandfathers name, who expired long back, when my father was a kid. the land then was in the name of my fathers elder brother.few years back my fathers elder brother sold a part of land and gave part money to my father and part money to my younger uncle to purchase lands in their own names and my father purchased 10 acres in his name.

Now my self, I am 38 years male. I did love marriage in 1992 and started staying seperately because my father got angry with me due to this marriage, but I was in connection with my elder sister and elder brother. my brother got expired in 2003. and my mother got expired in 2007.when my brother got expired, I came house and stayed for abt 10 days, but still my father didnt spoke to me.Now after 18 years I came back to my home town and still living seperate with my family.I went home to meet my father, bjut he was still in the same mood.

Now I want my share of the property.Is it possible to get the same?my father will not be easily ready for this, so can I put a application in the lower court and take stay on this agriculture land until I get my share?

Or I can send a notice to my father thru an advocate?

Please advise me in details, so I can move accrordingly.

you said it from your grand father's property, you have right for your share, if you really wish to get legally against your father wish then you can file a petition in court and get order.

You narrated it that your father purchased the land of 10 acres from the money given to him by your uncle after selling of your grandfather land since the land was ancestral property you have also right to get your share. If you wish to go against your father then you can claim for your share. File a suit but the burden of proof is upon you to establish the fact that your father has purchased 10 acre land from the money got to him by selling ancestral property( your grandfather land)

Thanks for your replies Sir,
As I said that, after my grandfather the land was in the name of my elder Uncle(Fathers elder Brother).He sold the land and gave money to my Father, My younger uncle and kept with him his part and they all purchased lands. My father and my elder uncle purchased lands together at one place but in individual names and my younger uncle purchased land seperately.Still we have abt 2.5 acres here near panipat which is in my uncles name but thats my fathers share and we too have home which is made in the land thats again on my uncles name as yet.I an get share in that also?

Also, do I have to give any proofs to the court that I am his son?What proofs those could be?As I do not have any document with me.but Yes, since our is a comunity, so Panchayat can say this. will it be acceptable?

You can claim provided you can prove. Documentary proof parentage may be your birth and school certificates. ,
