Anticipatory bail - regarding

SIR! IS IT APPLICABLE TO ACCUSED AFTER OBTAINING ANTICIPATORY BAIL FOR S.307 OF IPC, RATHER THAN GIVING CHANCE TO POLICE TO ARREST, CAN HE SURRENDER BEFORE THE REMAND COURT AND OBTAIN REGULAR BAIL ON THE SAME LINES OF ANTICIPATORY BAIL ORDER? -:- Adv. Y. T. R. Rao

Yes.
At least in WB the person getting the anticipatory bail need to surrender himself before the trial court within the specified time to apply for regular bail.

if anticipatory bail is allowed, police has no chance to arrest such accused and he is free to surrender before trial court and seek his regular bail.

I agree with Mr.Barman only. Mr.Makkad probably missed the language that anticipatory bail is given with the wording " in the event of arrest the petitioner may find bail of Rs.......to the satisfaction of Ld. CJM....." So the Police is always at liberty to arrest the accused.
