Solar water heating system - consumer complaint

Supplied Solar water heater system and installed against advance payment of Rs.35000/- and given Invoice stating to install proper backup heaters and subsidy reimbursement from government will collect the balance amount. Not informed any status of subsidy or even installation of backup water heaters even after almost one year completing. Understand from subsidy authorities the system not made in India and brought from China and not eligible for any subsidy. He was cheated and collected the money Rs.35000/- (Thirty Five thousand only) and given Invoice stating balance money will be paid after installation of backup heaters and subsidy.

System was under repair from September, even he is not abiding the Guarantee/Warrantee as he mentioned and given separate letter. In the letter he mentioned One year Gurantee i.e till 25-10-2011 and warantee i.e till 25-10-2015. Finally the repeated requests his employee Upendra took the SS tank for repairs and not returned till today. In spite of repeated calls his employee Upendra always telling me that he will inform MD to resolve the issue. At last I came to know through his employee Upendra subsidy amount and balance amount with out installing backup heater once I paid to him i.e Rs.19000/-, then only he will bring the system.

This is a clear case of unfair trade practice as well as deficiency of service.
File a complaint u/s 12 of the Consumer Protection Act.

you have stated that In the letter he mentioned One year Gurantee i.e till 25-10-2011 and warantee i.e till 25-10-2015

since the suuplier has failed to fulfill his contractual obligations under conteract during the warranty period the supplier is guilty of deficency in service . issue legal notice and file complaint for deficency in service beofre the consumer forum
