Starting of trial

Querist : Anonymous (Querist) 24 October 2011 This query is : Resolved
My doubt is about the commencement of trial in civil cases. Whether it is on the date of filing Chief Affidavit or on the date of recording of statements, kindly clarify
Devajyoti Barman (Expert) 24 October 2011
It is from the date of evidence.
Mere filing of the chief is not considered as starting of evidence unless on the same date is duly tendered by the plaintiff.
Advocate Bhartesh goyal (Expert) 25 October 2011
Yes trial of case begins when plaintiff tendered his evidence.

Civil cases comprises of mainly 04 stages:
1]Filing of suit along with affidavit;
2]Filing of written statement by defendant along with affidavit after service of summons;
3]framing of issues by court on the basis of pleadings exchanged between parties[pliant & written statement];
5]final hearing ,a] commencement of trial from plaintiff oral evidence getting concluded by oral evidence of defendant b]argument on either side;
THEN JUDGEMENT IS PRONOUNCED AND DECREE IS DRAWN.
Raj Kumar Makkad (Expert) 25 October 2011
Trial in civil suit starts from the framing of issues which is followed by evidence in chief and further cross-examination.
