Gift deed

my sister got an open plot gifted by her husband & the same has been registered on her name. two years later obtained divorce from a family court. Can the husband claim the plot in a court of law & can the gift deed be cancelled or reveresed by the ex-husband of my sister.

no, husband can not claim the said plot. gift cannot be taken back .your sister is absolute owner of the said plot.Valid Gift deed cannot be cancelled at the option of doner.

ONCE HE HAS EXECUTED THE GIFT DEED AND YOU ARE IN POSSESSION OF THE GIFTS IT IS DIFFCULT FOR THE DONOR TO GET IT BACK.

According to Sec. 122 of the Transfer of Property Act.Gift once executed can not be revoked/cancelled, on even the decree of divoce.
