Querist : Anonymous (Querist) 18 July 2011 This query is : Resolved
Hi,

We reached a compromise in police station in front of our relatives for Divorce. Could you please tell me what's the validity of compromise on plain paper with signatures of relatives and police personal.

Only the decree of divorce passed by the competent court of law has the validity , rest are the waste paper to say the least.

except the civil court decree no body has got authority to dissolve the marriage. Divorce before the police is not at all valid.
G. ARAVINTHAN (Expert) 19 July 2011
Court is a competent authority to grant a decree of divorce. No paper executed before relatives or no agreements/deed for divorce will have any legal value before any other court

In compromise its written that we will file a Mutual divorce in court and in return I will give the money and articles. Now they are insisting to give articles and money without reaching court else they will file cases against us. Is it possible. Please reply.
H.M.Patnaik (Expert) 19 July 2011
No. You have to file a Petition before appropriate court for allowing mutual divorce.

unless parties are able to prove a custom among them, there can not be a divorce without a decree passed by a competent court.
