Petrol Pump

(Querist) 12 May 2011 This query is : Resolved
One Petrol pump is started near the residential area (in Village). The distance between residential area and petrol pump is approx 300 ft. Owner of Petrol pump took ‘No objection permission’ from some people who are resided in that residential area (They not asked for all the people for ‘No objection permission’). And environment of that area is very polluted. And in that area frequently light is gone, so said owner number time use generator, so it’s also added noise pollution in that area. So, my queries are: -

1.What are the remedies available in law for those people from said owner who not obtained No objection permission ‘ for establishment of petrol pump?

2.What are the rules & regulation for starting petrol pump in residential area?

3.In this case can government can themselves take initiates and take action against said owner?

1. make a written complaint to the district collector regarding the nuisance/pollution
2. also give a written complaint to the oil company and ministry of petroleum and natural gas.

they initiate the action in this regard.

there are certain rules governing the opening of Petrol Pump at a particular site.

better will be to visit the official website of Ministry of Petroleum or you may seek requisite information using the Right to Information Act.

The Petrol Pump might not have come over night. If you had any objection, then you should have given your objection the moment that you came to know about the coming up of the petrol pump.

More over, I don't think that any serious environment pollution would be caused by the existence of a petrol pump. If that be so, then such a threat would have been felt even in big citities where the petrol pumps are in every nook and corner. Similarly, usage of Generator cannot also be said to be any of any noise pollution.

The license to store and distribute explosive, hazardous materials, petroleum, etc shall not be given as easily.
The applicant for the license has to get NOC or permision from various authorities of vatious departments.
The departments may include Fire Servie, Police, Revenue, Explosive deparment.
During inspection, the safety of the land, soil, etc shall be considered.
So, you cant simply blame the installation of petrol pump.
However, you can make representation to District Collector
