NI Act 138

(Querist) 26 March 2011 This query is : Resolved 
In NI Act 138 I am Adv. for accused. I have crossed to the complainant. After then complainant again filled some documents to fill the lacuna. Is it admissible after cross. If no is there any citation to show to the court? Please help. Thank you friends. Have a good day.

If the evidence of the complainant side has not been closed then documents subject to the permission of the concerned court can be got tendered by complainant may those fill the lacuna of case or not. Documents can be got objected by defence side.

Complainant can be produced by filing an application, you have got right to file an objections to such an application. You can object for it by filing an objections. Court can pass any order after hearing both sides.

You may file the objection, but if additional documentary evident is admitted, you may also request the honourable court to allow you to re-cross-examine the complainant in view of the introduction of the fresh document.

complainant can file documents and call witnesses until the complainant has closed his evidence in the case. thereafter only, the accused enters on defense and to lead his evidence.
