Legal value of "Attested copies without original" ?

Querist : Anonymous (Querist) 21 March 2011 This query is : Resolved
What is the legal value of attested copies of a document (attested by a Gazzetted Officer or a Notary Public), when the original of this document is not present?

I mean, could such attested copies, whose original is not available, be considered valid by a Court or not ?

Unless you get a court order for production after hearing these documents have no value.

No validity without original document for the purpose of verification. You can't convince a court of law about the originality and authenticity of the attested copy of the document in the absence of the original document.

This query is in repetition, as your query appeared earlier also. Probably you wish that some body should ensure that the document is considered legally valid in the absence of verification from the original document.

However, that depends how you are able to convince the law about the validity of that document.

My query is quite clear, yet I am trying to make it clearer----whether a photo copy of a particular document, which has been duly attested by a gazetted officer, be considered as good as a original copy, by the Court of law or not ? Original of this photo copy can never be produced in the court, because original of this photo copy has already been destroyed.

Please re-answer......

Mr. Dhingra, this is the first time ,I have posted this query.Perhaps someone else posted similar query, please give me the link so that I may visit and get some thing from that link.

Nevertheless, should I understand that without originals, copies attested by a gazzetted officers do have no value in the eye of the law?

Please reconfirm..

Yes , it is a secondary evidence and admissible in evidence. Section 65 of the Indian Evidence Act is quite clear about this.

I agree with Devajyothi
