Notice Period of 3 Months

I had left my job in May'10 after giving notice of 20 days although as per Appointment letter i have to give 3 months notice i am ready to pay at that time the shortfall in notice but my repetative reminder to HR Manager he is not ready to give my full and final amount now after 6 months he send a notice at my home regarding the shortfall , so my question is it necessary to pay the notice amount we i will not pay than what will happen, my P F and Bonus are still unclaim

Please guide me as early as possible.

The company can claim the 2 months and 10 days salary as compensation. YOu can claim your PF, because the PF amount will not be with the company, it will be with the PF authorities. If you know the PF account claim it directly from PF department.

The company is well within its legal right to charge notice pay of remaining notice period by way of filing suit for recovery in the proper court of law and you shall have to face such litigation at your own cost and expenses along-wit mental and physical harassment.

Your provident fund is immune from any recovery. However, you are liable to make payment for short fall in notice period. It can be recovered from your other dues such as unpaid salary, earned leave salary etc.
