Injunction

(Querist) 24 January 2011 This query is : Resolved 
Sir,

Spouse got ex-parte divorce in dist court.

The injuntion suit can be filed in High Court or only in the Lower Court, to stop the marrrigae of the spouse.

Please enlighten me.

You have to appeal against the exparte order. Once the appeal is filed and admitted the spouse cannot go for another marriage unless the appeal is disposed off.

appeal is not necessary. You go to file a petition to set a side the exparte decree in the same court. if it is delayed you file condone delay petition along with the set aside petition.
Whether the decree is contested decree you can go to appeal. Otherwise need not go to appeal.
