VAT & service tax

(Querist) 03 January 2011 This query is : Resolved 
I have booked the flat ( under Construction) in MAR-2009, all the payment due has been , now builder had send demand letter for payment of VAT @5% on agreement value along with Service tax @2.6%, whether same is applicable ? pl reply

If the residential complex where you are purchasing the flat has more than 12 living units (i.e. flats) then you are liable to pay the service tax as also VAT.
