Unintentional absence on the hearing date

Dear Experts,

Would be grateful to have your response.

Am going through a divorce case in the family court. For the last hearing by mistake I went to another room rather than principal family court and kept on sitting there in the wait that my name would come. My advocate came very late and then only I knew I was in the wrong room. By the time I went to the right place, we were told my name was called BUT i Was not there and since my advocate also was late he could not represent me either. My husband also did not turn up but his advocate was there.The court has given another date for hearing after a month.

Do you think it would have adverse impact on my case? I think we did not let the judge know that there was a confusion and I was there all the time but in the wrong room.

Please let me know as I am a bit tensed up over it.

Relax. That incident has no impact on your case. I believe you have got the next date. So be at the right place at right time on next occasion.

Did you check the order sheet? If not, You should check the order sheet of that day through your counsel immediately. Because none was appear on your behalf. If there is not any adverse order you may relax otherwise pray to set aside the order giving the reasons as you stated above. But no need to be tensed it not a fatal incident.

Dear Arvind I did not check the order sheet. But my advocate looked into it and told me that the next date falls next month. So I assume that as other experts have opined, everything should be fine. or I should still go and have a look at the order sheet.

Comments from other experts are welcome. Please guide me as I am very new to the procedure and the court ettiquets

Devajyoti Sir, you mean I need not go to check the records since already the date is fixed for the next month? Or should I go and check the records before the due date of my appearance in the court? I am sorry to be taking so much of your valuable time. Thanks .

I agree with experts. You can go and check the records a few days before the hearing.

Thank you all. I went today and inspected the case diary of the relevant day. No adverse order. Just the date was given and an instruction that both parties to be present without fail. Thank you for guiding me.
