(Querist) 10 September 2010 This query is : Resolved
Can an employee holding law degree carry out law practice rendering legal counselling to clients and involve in all Back-end jobs related to court matters assisting a Senior Advocate?

as per our professional ethics any one employee can not be an advocate.. but he can give counseling to clients..

like that he can involve in all Back-end jobs related to court matters assisting a Senior Advocate.. like drafting.. typing.. but he can not do any representation in court hall..

simply an employee can be a lawyer.. but can not be an advocate..

thanks for this opportunity.

Free legal counselling for poor people who cannot afford to pay lawyer's fees can engage such lawyers for which, Bar Council must recognize such services and necessary amendments to its Regulations to this effect including Advocate's Act is the need of the hour to add value to Advocate's profession.

Yes. Your views are right. Unless they are recognised and brought into the relevant statutes it will not be possible for any such law gradulate to practise.

There is only one clause in the BCI Rules to be updated to enlarge the purview of law practice which would reduce the burden of pending cases and reduction of litigation in this country by professional involvement of more law qualified graduates.

Well it depends on the terms of the employment contract of such Law graduate. However, there is no bar to giving the advices to the people on legal points. Normally such law graduates can not appear in courts for full fledged practice.
