I was a Central Government servant. I had been convicted in a criminal case. The President has passed an order under Rule 8 read with Rule 9 of CCS (Pension) Rules, 1972 imposing a cut of 40% of my pension for a period of 7 years. In this concern, I have the following query -
1) Whether my Commutation of Pension shall be calculated on my original pension or on the 40% reduced pension?
2) Whether the Dearness Relief be paid on original pension or on the 40% reduced pension?
3) Whether the reduction of 40% be effected on Gratuity also? (The order specifies only pension and not Gratuity).
I shall be much grateful for your valuable replies.
Thank you to all Learned Experts in advance.

Hello everyone,
I work in a PSU and after requesting for the past two years I finally got my request transfer to my home state in April this year. The transfer order dated February 2021 from the circle office was received by me and the branch in April but my branch incharge is not willing to relieve me despite numerous requests and genuine concerns due to the pandemic. I've followed it up with the HR section, GA section and other relevant offices, with no reply. Is there anything I can do legally?

I was posted as a Junior clerk in District Court since 2013. After that I was transferred to Family Court in 2017. There I had passed higher examination in 2018. I got promotion as senior clerk in 2019. After that in 2020 due to abolishment of post I was demoted to junior clerk again. But after 3 months only the post was resumed of senior clerk. But till today I was not resumed as a senior clerk by the authority as they are saying that you are not eligible as you are downgraded in gradation list. So I just want to know that do I lose the position in gradation list due to reversion ?
