I have a small area property which only 0..6 cents.(5metere×5metre,).Can I construct 120msqare shop room in this plot .is there any objections from government?Can I dig a bore well near to boundary line without consent of neighbors?

Stamp duty on transfer

I and my brother are the joint owners of the property in 50:50 ratio. Now my brother wants to transfer his entire share of 50% to me without any consideration by way of gift deed. The property is situated in Maharashtra.

What will be amount of stamp duty on gift deed?

Division of property siblings who are unwilling to sell off

Hello, We are three brothers and one sister. Our father passed away leaving behind a house interstate without any will. One brother (A) is living in that house and financially is not well off. Rest of us are living in our own house including our married sister. The sister and brother (A) are not willing to sell off house as A has nowhere to go. We two brothers want our share in the house. We had assumed that A would find another place to live with his 25% but that doesnt seem feasible to him. What are the options to divide/ sell off the property so that we can help our brother and also get a fair share in the house?

Guidance value vs market value and impact on capital gain

I am looking to buy a property in Bangalore whose market value is 70L. But its circle value/guidance value is 55L only. The seller is saying that he will mention 70L on sales deed, but we can go for registration at circle value which is 55L. First question, is it possible?
The seller is saying that this will help to save some money for me.

Now if I sell this property in future , than capital gain will be calculated based on circle rate (which was 55L when I purchased) or the actual market price which was 70L at that time. The seller is saying this will be calculated on market value of 70L and not on circle value of 55L, please help me with correct legal guidance.

Ownership of property purchased on affidavit

My father were 4 brothers. They had some verbal partition in 1975, of our property in which one small land property was given to my father, which was Khatiani in name of my one uncle. The dakhil kharij of land was got done in Anchal on the basis of Affidavit from my uncle before 1st class magistrate in 09/2011. Since then we are paying Land Lagan Anchal receipt in our two brothers name as father expired in 1989. (& Municipal Taxes from 1995).

In 2016 one dispute occurred for Road going to the land and my uncle has filed a case on us. Off the court, it is being heard that Dakhil Kharij of our property will become invalid and will be broken if they tried for this.

I want to know that is this transfer of land is valid for all purposes or not. What is the valadity period of a property transfer on Affidavit like this?

Duped into selling a house

I had a house on my name which was paid for by me. My father (now deceased) duped me into signing the documents. He then went on to sell the house and then purchased another house using the proceeds from my house.
My father passed away and legally my mother is the heir. My mother denies it, inspite of knowing the details. I have three siblings who want a share in the house, although it should legally be mine. I live in another city and all the documents are with my siblings/mother who do not want to share it.
What should be my next step? What documents do I need to prove that they do not deserve a share in that house.

Suit for cancellation of partition deed

Query regarding –
We are two brothers and Father (mother passed away long time back in 1995) .
Me and my brother were Joint owners (50%-50%) of a house (with 4 floors) In West delhi.We executed partition deed 2+2 floors

We had written in Partition deed we both will not interfere in each others property. Now , my father passed away 3 months back in sep 2020 . Now as per law , I have to execute my fathers will and do mutation in my name for Noida flat. Authority also asking for NOC. But my brother is challenging the unregstrd Will
Now , my query is that I want to cancel the partition deed by filing suit.

Information about mutation

Dear Experts,

I have purchase a new flat two years ago. After 1 year of purchase, we got to know that fourth floor in not there in sanction plan. It is there is "as made" plan. Unfortunately I am in fourth floor.
Can I still do mutation of my flat? The other flat owners at 2nd and 3rd floor are also concerned whether they can do mutation.

Can you please advise both quieres? What are my legal options?

I forgot to mention that we are requesting builder to provide completion certificate but he is not providing this, neither denying to provide.
