Adoption is completed through Court Order by Principal Judge, City Civil Court ,Mumbai in 1995. Can I make Deed of Adoption now making reference of the order of Adoption?

Request for advise

Sir, I, Prasad, bring to your kind notice Bank has considered only Point No 1of Avtar Singh's Case and neglected all the remaining points. So, I filed a case against Bank in the High Court . But, till now, Bank did not file the counter. This High court officials told that unless the Bank files counter, the case cannot be settled.

Co-operative society byelaws on ownership of property

I am owner of 1/2 undivided portion of a residential plot in a Co-Operative Housing Society at Pune.

Some time back the society amended its bye-laws such that the plot can be owned only by members of family. The purpose was to prevent influx of builders & construction of flats on plots. It is not clear as whether such amendment is consistent with MCS Act.

I intend to sell my share in the property to a third party, since my brother is neither willing to give me a fair compensation. At the same time he is also not willing sell his share to me at a fair market value. The property is in possession of my brother.

Some parties have evinced interest in acquiring my share of the property. But as per existing bye-law, the society will not allow membership of the society to any person/entity.

What could be a practical & a possible solution.

Obtaining possession of undivided portion of property

I am owner of half share of a 3600 sft. residential plot of land in a Co-Operative Society at a prime location in Pune city.
I have managed to get my name mutated on the property card after obtaining a succession certificate from court towards my half share.
For this I have faced prolonged litigation for last 22 years by my younger brother, who is in full & absolute possession of the property. The premises are being used as an office by a business entity owned by my brother & he is living elsewhere.

Need advise on

1] How to proceed for demarcation & possession of my 1/2 share of the property.
2] Upon obtaining possession, I wish to sell the property. But the bye-laws of the society do not permit joint ownership outside blood relation, which
in my opinion itself is against any provisions under the MCS Act.
3] This means that I can sell my share to my brother only. But he is not ready to purchase the same at fair market value, in spite of having adequate
financial strength.
4] My brother is also not willing to accept my offer of a fair market value for his share.

What is the way forward to resolve the issue.

Recovering a debt from a friend

Can I file a civil law suit for recovery ? Is the amount recoverable even though a written agreement was never executed?

House tax

Before Lock down I had purchased free hold residential plot with in nagar nigam limits.but intend to build after one year hence,question is would I have to pay house tax for vacant plot ,second will the area circle rate be also applicable on open/vacant plot?

Status of lessee occupied land by propritory concernr demise

I am the owner of plot. Piece of land was given on lease by agreement with proprietorship firm. If propritor expires how can I get back possession of plot? The lessee was defaulter of lease rent.
