Non payment of dues-housing society

We have put up the names of the payment defaulters (maintenance+prop tax) on the notice board. One of the defaulters, objected to it and said that this is against the bye-laws and will sue the society.
Is there such a restriction?

Transfer of flat

Agreement of flat in our building(purchased from builder) has first name of the eldest son and second name of his father. Recently the father has passed away. The father has another son, a dauhter and a wife surviving. The eldest son (whose name stands first in the agreement & in the share certificate) has written to the society to replace his late father's name with his mother's name. Is it necessary for the society to obtain NOCs from the other brother and sister to transfer the same to mother

Registration and stamp duty duty while leasing flats

Is it compulsory to register and pay stamp duty while leasing flats in a co op hsg socity?

Is it legally binding on the society to aceept leased documents which are only registered?

Querry on housing society.

Our Hsg society got our building reconstructed and we re-occupied in April 2009. Some of the members had added associate members before reconstruction and the previous committee had written down the names of associate members on the share certificate, mentioning “associate member” in some cases, and not mentioning in some cases. However, the new agreement (duly registered and stamp duty paid) done with the builder for new flats shows the original owner and the associate member.
Is this in order?
We have a specific case which has come to us.
One of the flats, was transferred to a widow when her husband died. She has four sons. However, just before reconstruction, she added one of her daughter-in-law as an associate member. Her name was added by the previous committee in the share cert without mentioning “associate member”. In the current agreement made with the builder for the new flat (after reconstruction) between the original owner( the widow, who is in fact, the care taker) and the associate member. To a person who do not know the background, the agreement (duly registered and stamp duty paid) shows the care taker and her daughter-in-law as the owners.
Now the widow wants the 100% shares(transfer of the flat) to be transferred to the daughter-in-law. The new committee has asked for time to decide on the matter and meanwhile asked the widow to get NOCs from all four sons.
1. Can we transfer the flat once we get the NOCs?
2. If so, will the agreement need to be registered and stamp duty paid again?

Powers of Co Op society

Our society in a gen body meeting had decided that the staircase, landing and other common areas will not be used for storing, including shoe racks, by any member. After the resolution was passed, 3 out of 4 members who had kept thier shoe racks in the passage removed them. But one member is adamant that he will not remove and society can do whatever it wants. Can the society physically through out the same? What recourse is at society's disposal?

BUILDING COMPLETION CERT OR OCCUPATION CERTIFICATE?

Ours is a co-op hsg soc registered over 20 yrs We got our building redeveloped recently through a developer. He has obtained a Building completion certificate and says that there is no need for an occupancy certificate when BCC is obtained. Please confirm.

who is responsible for a leaking terrace ? society or terrace owner

There are 3 flats in my society with attched private terraces. There is a clause in the sale agreement clearly stating that the flat owner is responsible for any leakage from the terrace privately used by him.
Will the judgement by the high court of mumbai high court in the case Mr.Balani versus Humble Home co-op society society was held responsible in the maintenance of the terrace even though it was privately owned.
In view of the clause in the sale agreement that the terrace owner is responsible for repairs of leakage from his terrace will the above court order apply?
