Seeking help to gaurantor

Dear Sir,

All your suggestions are excellent.One my friend stood as a guarantor
at OBC, Ameerpet branch, Hyderabad, to a firm who availed a CC loan of
Rs.60.00 Lacks, the guarantor has mortgaged his flat value Rs.25.00
lacks along with borrower flat value Rs.18.00 lacks.The account became
NPA in 2013. The OBC officials has started sending notices both, and
filed a case against both at DRT, Hyderabad.At Lok Adalat we requested
to settle for Rs.35.00 Lacks which they have not accepted and final
settled for Rs.43.00 lacks. The judgment was in favor of Bank, they
obtained an order to take physical position of both the properties
through advocate commissioner appointed by the Honorable Court and
published in paper for auction scheduled on 15th October,2015. As a
guarantor we again requested the Branch Manager who asked us to see
the Regional Head.The AGM at Regional Office has not cared to talk
with us.He shouted on us and asked to go out if we dont pay Rs.40.00
Lacks on 30th September,2015 since it is Half Yearly closing day.We
were ready to pay Rs.20.00 Lacks on 30th and balance Rs.18.00 before
action date subject to their OTS letter.They refused.We have no other
option to stop stop the auction of guarantor flat we have appealed to
Honorable High Court for seeking relief of stay which has been
granted.After stay is granted we again approached the Regional Head to
consider our request for Rs.38.00 Lacks and the Regional Head has
considered for Rs.39.00 Lacks, which we have accepted subject to
condition against the OTS letter immediately the guarantor has to
remit Rs.25.00 Lacks and pre delivery of position of guarantor flat,
and balance Rs.14.00 Lacks within two months to release both the
documents, and asked us to submit letter to the branch manager for
recommendations to obtain permission from their Head Office.

When we approached the branch manager on the same auction day, he
refused to recommend and he will discuss on the second day. Next day
he informed us the flat of the main borrower offers were received and
he cannot consider our request, still we requested him to recommend
for Rs.39.00 Lacks, after deduction of the offer received for the main
borrowers asset, we will pay the balance in a single payment which is
arriving to Rs.23.00 lacks, he has not accepted and demanded to pay
Rs.25.00 Lacks, like wise the Branch manager has troubled the
guarantor now who is on the road with wife and two children.One boy is suffering with brain tumor, he needs personal care of parents which is now not possible.

Please suggest us what kind of auction can we take on the Branch
Manager who troubled us for his own benifit,

Seeking advice to protect property

Dear Experts,
One of my friend at Hyderabad stood as a guarantor to one firm at OBC by mortgaging his property having trust and faith on him.The loan amount was Rs.65.00 Lacks against partners of the firm property and my friends property in the 2010, now the firm is closed and the CC account became NPA. The case is filed by the banker,everything is kept in darkness to my friend by the firm partners.To recover the bank liability the banker has obtained attachment for the properties in which my friends property is attached, the advocate commissioner has come to my friends door to take the physical position of the property. Al ready e-aution was conducted by the banker but no body has participated.
My friend is ready to pay Rs.10.00 lacks to release his documents with free liability but the banker is not accepting.
Now my friends wife file a case to protect the property by paying Rs.10.00 Lacks and release the documents what will be the results.Please show some solution.

Regarding mv act

Dear sir,

I am from Hyderabad,self employed.My office is on the main road at Balanagar.There is no parking place in our area.Everybody should park their 2 and 4 wheelers on the left side of the road. In the same way I was parking my car totally on the left side of the road.There is no any caution board or No Parking board, it is a garbage area,Every day the traffic police use to take snap/photograph and started sending me notices u/s133 of MV Act,1988, when i checked the traffic challans I was shocked to see 38 challans @ Rs.235-00 each is due from my end, but I did not received any challan, earlier to that I have paid 10 challans, but vender on the road side are not charged.I used to park my vehicle inside the white marking lane of the road.

Now my question is without any information,or No Parking/Caution Board,how can the traffic police can take the photo graph of my car and send me notices which I feel it is not justified.

Please help me in advicing me what further step can I take against this notices.

To clear the bank liability settelment required

Dear Experts,

We have purchased a single bed room property, the fact of bank loan was kept in darkness, when we asked for seller documents he told that it is in bank for amicable amount. One fine day banker came with seller to our door and cautioned the barrower, when we tried to explain the banker they refused to listen what we are saying, and also they asked why you have purchased the property without proper documentation. At last the barrower has paid and Rs.60,000-00 was the balance as on date. since six months the barrower is absconding, we are planning to pay the amount if the banker allows us to settel the account.We are ready to pay to avoide the risk factor. Please advice us can the banker will allow us waiver of intrest.

Validity of registration

Dear Experts,

One X is due for Rs.20.00 Lacks to Y,There is no proper evidence for Rs.20.00 Lacks,and X is having a property self acquired worth Rs.55.00 Lacks on which Rs.16.00 Lacks mortgaged to Bank.Now to avail loan through Y as his profile suits to eligible for housing loan X has done sale agreement with Y for Rs.63.00 Lacks with an advance of Rs.1.00 Lack, Now Y wants to recover his amount from X through this transaction, by depositing 25 to 30 lacks in X account through RTGS in 5 to 6 transactions, and he will collect back the amount from X, by which the amount routed through bank will be effecting the sale agreement, and for the balance sale consideration payable to X (Rs.32.00 Lacks) first Y will clear bank liability to release the document and the balance will be paid before registration.

Inview of X all this transaction is only to avail housing loan in favor of Y.Now after registration how to get the house property to Y as the tenants are paying rents to X.After registration legally can the tenants be vacated.Please advise as the case is critical.

Fraude by ludhiyana financer.

Dear Sir,

One of my friend has attracted for the financial advertisement in the website.www.Darshan Associates, Zirakpur, Ludhiyana, they advertised for different types of loans at low intrest.My friend approached Darshan Associates to avail loans on his property to a tune of Rs.1.50 Cr.@3% intrest Per annum.They have given sanction letter and to process the same they collected Rs.3.00 Lacks (By way of DD) as a processing fee three months back.When ever he approached for the loan over phone he used to tell that a team of advocates will visit within 3 days and loan amount will be disbursed.Again he demanded Rs.2.00 Lacks as a bribe to advocates, my friend paid Rs.1.00 through RTGS to his account, now they are not responding for calls.My friend understood that he was cheated, two time he visited Zirakpur by spending Rs.1.50 Lacks for flight tickets etc. Now how he can recollect the amount paid and routed through bank by him.Please advice where to lodge complaint, how to recover the amount paid by my friend.

Seeking advice from experts

Dear Experts,

My brothers soninlaw is accused in a case at Vijaywada,4 to 5 non bailable warrant was issued in his favor under cheating case, he has borrowed huge amounts from local pupils and absconded. Three months back all of sudden he came to Hyderabad and asked to financial help, as he was hunting job.I have helped him 1000-00 he stayed for 3 days in a hostel and again he asked me money, I refused and took his mobile phone, it was samsung, I was using the mobile for the past three months, with the help of EM number the vijawada police reached me and asked me to start vijaywada with them for enquiry,and recording my statement.They are suspecting me that I have hided him,In fact I dont know where abouts he,

I requested them since no warrant was issued in my favor, I will come after 3,4 days.Is it safe if I visit vijaywada without taking any precautions.What sort of precautions I have to take.just using his mobile I have not done any crime.Please help me by advising me If I go for anticipatory bail before visiting Vijawada, or shall I surrender in the court.They may make to stay in their custody for 2 to 3 days and harass me for tracing my brothers son in law.

Car parking place reg

Dear Experts,

We have purchased the double bed room apartment through bank auction and took the position.In the document car parking also mentioned.But there is no provision for car parking,Car parking is available only in front of the builder ( Ground Floor), he is not allowing me to park the car.By force I have parked my car after removing he locked the gates.

Now what kind of action I can take, on whom I have to take, Bank or builder. Builder has hypothicated in the bank and bank has auctioned we have purchased through bank auction.

Reg car parking place

Dear Experts,

My landlord has purchased a double bed room flat in the year 2007 through bank, bank authorities gas auctioned the property,it is in second floor.The building consisting 4 double bed rooms portions and 4 single room portions.the actual owners resides in ground floor, he was due to bank and bank authorities has auctioned and my land lord purchased and got registered the apartment through bank authorities. In the documents car parking of 100 sft also registered.
Due to some family disputes the builder has handed over the ground floor portion to his daughter who is NRI, she gave the house to rent.

Now the problem is the tenant is not allowing to park my car in the ground floor, he is locking both the gates.yesterday by force I have parked my car in the premises, the land lord from US has complaint to local PS, they came and saw the document and asked me submit the link document,when I Approached P.S, with links document they are asking to file a civil suit and claim my right of car parking.for the entire building there is no provision for car parking but for in front of the Land Lord Staying in US, now what I Have to do to avail parking place as per the document. On whomever shall I file the case, what relief I will get through court.

Query regarding gaurantor

Dear Experts,

One of my friend has to get Rs.15.00 Lacks from a civil contractor, the civil contractor has put in loss, he is having property,and availing loan on the property from private finance M/s. Darshan Associates, Punjab which is sanctioned Rs.1.50 Cr.They have undertaken the property from a nationalise bank by clearing their dues.(Take over loan), as a formality they are asking a 2 IT payer gaurantors.The civil contractor is requesting my friend to sign as one gaurantor.The property mortgaged value is nearly Rs.2.00 Cr.

Now my query is in case if my friend sign as a gaurantor, if some thing goes wrong after few years, what kind of problem he has to face if he is a gaurantor.

If the civil contractor two sons agreed to under take and giving in writing stating that if in worest case they will clear the loan, is it Ok

Experts Please advice the remedy or suggest my friend not to be as a gaurantor.
