Dishonoured Cheque

Dear All,
My cheque has been bounced two time with a remark `insufficient fund` In the meantime, some `turmeric stains` ( Haldi marks ) have been put on some part of cheque & it looks dirty. If now, I present the cheque in the bank & it comes back with a remark as dirty cheque etc. & not as `insufficient amount`. Can I send him notice for bounce of cheque? IF NOT, THEN WHAT IS ALTERNATIVE TO SEND HIM NOTICE OR FILING THE CASE. ( HE WILL NOT CHANGE THE CHEQUE NOW )

first present and see the remarks and then decide.

Present the cheque in your bank first.

No way a bank is legally entitled to dishonour a cheque on account of such reasons unless there is material alteration or insufficient funds. You can file a complaint in the Banking Ombudsman through onlline

THE CHEQUE IS ALREADY RETURNED DISHONOURED TWICE.CAUSE OF ACTION ALREADY AROSE WHEN IT GOT DISHONOURED FIRST TIME.

AFTER SECODND TIME DISHONOUR OF CHEQUE IF IT IS STILL IN LIMITATION THEN SEND THE NOTICE IMMEDIATELY

IT LIMITATION PERIOD IS OVER THEN REDEPOSIT THE CHEQUE AND SEND NOTICE WITHIN LIMITATION PERIOD.

If you have not issued notice so far after second return and if one month has not elapsed,you can serve the notice and file the complaint.

i agree with Mr. Sawant here that the cause of action has already begun after first bounce.

visit some lawyer, find out the limitation period available then move accordingly.

need not to present cheque again.
