Fraud institutes

(Querist) 07 May 2010 This query is : Resolved
Respected Sir/Madam,
I have a query regarding a fraud institute who promised me to give job after completing a course in 2008 and has not given me any job yet. These institutes send mails & gurantee you jobs telling you big big companies name ... and they never provide job.
Pls suggest me legal actions i can take against them.
Thankyou.

The terms governing your employment after completion of the course will decide your case, if you have a valid agreement that assures placement but till date you are not placed then you can file a case of cheating u/s.420 IPC against the institute and its management.

The luring of the customers/students towards such courses by making false assurances orally or in writing is definitely an unfair trade practice which is also an offence so you can go to consumer forum as well as in civil court against such company.

Hi All,

Raj's view point is totally out of sinc as in the instant case the relationship amongst the parties is governed through the contingency and if you are not getting the job then the presumption is that there is no vacancy as such (you have not mentioned that any other similarly situated person has got accommodated as such neither there is any time period stated for this purpose).

I would like to suggest that you should first put the institution under notice and in the eventuality of admission or unsatisfactory reply resort to filing a case at appropriate forum/court.

Best Regards

Daksh

You have paid for the course and has undergone the course. The promise of job is not included in your course fee. Therefore, you are not cheated.

If a promise is made orally or even in writing that a job would be given it cannot be enforced or called cheating. To get a job goes with many conditions like your aptitude, eligibility, performance etc., for that particular job and a blank promise does not include all these conditions. Therefore, when a person promised you a job, you should only think it as his wishful offer that may or may not materialise and you cannot proceed against that man legally.

I totally concur with the opinion of our learned friends Mr Daksh and Mr.Rao
