A senior citizen who has not formally married married will he be eligible to take his partner's pension ?

No. Live-in-relationship do not provide any legal right in favour of partner equivalent to wife so no question arises to claim for pension of another's service.

i agree with my friends, the long living between a male and female may create fiction of marriage, but for the purpose u ve mentioned the legal right has to be created by actual conduct.

yes, his/her name is given as nominee to receive the pension,he/she can get pension.

however,if a Legal heir challenges the same in a court of law,the surviving partner in such living in relation might loose

No he will not be eligible. He has to prove his legal status though he may be nominated. Legal heirs can challenge it.
