Who is a pagadi tenant

We seek answer without any ego issues or fight between lawyers
Question is as per current law,how much maximum rent can owner take from old tenant so he can maintain his bungalow?
Can owner increase upto Not par but at least 50 to 75 percent of current rent value?
Why process so difficult that tenants turn shameless

1. What documents a old tenant needs to prove he is pagdi tenant?
2. All over Mumbai tenants stay in rent of rupees 10,100 very cheap, What prevents owners from increasing rent while tenants are ungrateful

1. Rent receipts and even record of BMC contain such event in its record.

2. There are various Government notifications which prevent such owners to enhance the rental amount at par with the prevailing in the market of the similarly situated property.

What is the purpose of tenant to prove that he is a pagdi tenant ?
Whether landlord has issued any receipt, if so any records maintained by landlord?
Maharashtra Rent Control Act, 1999 applies in such case(s), where landlord can increase rent or prevented to increase arbitrarily.

You have not mentioned the actual problem, in absence of relevant facts query sounds academic query.

Reply:

Legally it seems difficult to increase rent to such an extent unless agreed by all parties / ordered by competent authority. There is no question of shamelessness, action in accordance to law is not shameless turning.

Agreement, receipts can be proof. Discuss in detail with local lawyer in reference to the actual documents / proofs held by the tenant.

No landlord wants such situation. Law is favoring such tenants.

This is nothing but a repeated query, though 'anonymous'. The facts earlier posted suggest the ingredients of Pagdi system. In Pagdi system, the tenants are legally recognised to be co-owners and their rights are legally protected.

The only option for the landlord is redevelopment. Yes, the tenants rights needs to be protected. But the extant norms, to my knowledge, allow extra FSI on this account.
