5th floor flat registration problem, panchayat, nizampet, hyd

Querist : Anonymous (Querist) 22 June 2020 This query is : Resolved
I have purchased a flat in Gram Panchayat, Nizampet, Hyderabad. Which is on the 5th floor. The official permission is only for G+2, but the builder is having all the documents for the building (Sale deed, approved plan, and OC).
When will be the registration process is done for the above G+2 flats (5th floor) in the Panchayat area in Hyderabad? Now it is on hold from the Govt officials and happening only for G+2 flats.

Have you purchased the property without the registering the deed? If so, your title is less than perfect. Transfer of title could be completed only once the deed is duly registered.

Hyderabad High Court Honorable Justice A.V. Sesha Sai on 19th June 2018 it self had issued an Prohibitory Order banning Sale Of Flats in illegal and un approved apartments. Discuss with Hyderabad High Court Civil Side Advocate in detail.

You should have avoided such flat constructed without proper authority.

Send notice to Builder, file case for refund with interest with RERA or consumer Forum.

Unapproved construction is invalid in the eyes of law and none can tell the exact time to be taken by Hon'ble High Court to decide the pending case.
Rajendra K Goyal (Expert) 24 June 2020
No alternate left but to wait till the construction is regularized.
Raj Kumar Makkad (Expert) 24 June 2020
As the case is pending before High Court so you have no other option but to wait for its outcome and also the fate, if the same is also challenged before Hon'ble Supreme Court of India.
Rajendra K Goyal (Expert) 25 June 2020
Author need to have close look / follow up on the proceedings / outcome / subsequent appeal on the issue and hence proceed accordingly.
Dr J C Vashista (Expert) 25 June 2020
When the sanctioned plan is for G+2 whereas the builder (out of greed) flouted the laws, why did to go for purchase of flat at 5th floor, which is an illegal construction and likely to be demolished.
Rajendra K Goyal (Expert) 25 June 2020
Agreed with the plain advice from expert Dr. J.C. Vashishta ji.
Raj Kumar Makkad (Expert) 25 June 2020
Greediness and tall claims and in-depth advertisement of the builders/promoters do attract common person to invest their hard-earned money in such projects.
Rajendra K Goyal (Expert) 26 June 2020
If the author is of the view that the permission and hence registration is not possible in near future, he should proceed to claim back his payment in the consumer forum.
Raj Kumar Makkad (Expert) 26 June 2020
Option of RERA is also available to the author if he has any dispute with the builder/promoter.
Rajendra K Goyal (Expert) 26 June 2020
RERA can be approached, yet usefulness of consumer forum cannot be overlooked.
Raj Kumar Makkad (Expert) 26 June 2020
'is also' was the word with RERA with do not deny the usefulness of Consumer Fora. RERA is a specific authority constituted to deal with such specific matters.
