Demand of Arrears since 1998

My client is running a petrol pump and PWD B & R Deptt. has sent them recovery notice demanding arrears since 1998 for use of approach road adjacent to highways as lease charges,is this notice is a legal notice as arrears which they are demanding are barred by limitation of three years for recovery,as i think, kindly clear me regarding this problem.Thanx

Yes. The notice is legally valid and enforceable. The Government has power to recover its dues as arrears of land revenue for which no period of limitation has been prescribed. However, even for suits filed by or on behalf of Government limitation period is thirty years by virtue of provision contained in Article 112 of the Schedule appended to the Limitation Act, 1963.
