Filing petition against illegal owner of stilt parking.

Dear Sir,
I stay in thane since 2005 in co op hsg society. total members 28. after formation of society it was decided not to purchase stilt space for parking from builder. Still few members (6 out of 28) purchased the same from builder. In 2013 it was decided in the meeting that legal ownership of stilt is with society and no member is authorized to sale or purchase parking. After this also few members sold their parking to other members / new flat purchasers.
I would like to ask that where (in which court) we can file petition against such members?

We have committee of 9 members out of which
4 members holding imp position are owners of parking
3 are neutral
and 2 r supporting parking transactions.
I would like to ask whether we can remove such committee from power and form new one?
Our secretary is not owner of flat. He is having power of attorney from his brother to participate in society affairs. I would like ask, whether he is entitle to hold this position in society?

Dear Smt. varsha,
You can approach civil court or co-op. registrar. And you can remove committee members and conduct fresh election.

Repeating same story is absurd and ridiculous.
It would be better to consult a local prudent lawyer with case file for appreciation of facts & circumstances and guidance.

Before approaching the Courts, it would be in the fitness of things if the Issue is discussed in the General Body and decision is taken on the basis of the prevalent norms.
