Practice law

(Querist) 04 December 2018 This query is : Resolved
Dear sir ,

I applied for temporary enrolment and got my enrolment number and have to write the bar exam to convert it into permanent enrolment number. My query is whether I am eligible to issue pre suit notice and draft various legal documents with my temporary registration?

You may send it through some other lawyer but not in your name.

1. There is no bar to Draft ANY Legal documents, as long it is limited to drafting, further PROVIDED that you do not mention the title "advocate" while signing the same. You would NOT be entitled to appear /argue /represent in the capacity /title of an "advocate", before any Court /Constitutional Authority.

2. AFTER the Bar exams, you would be governed by the Advocates Act, with a practicing certificate, to fully claim the title of an "advocate", for all related purposes.

Keep Smiling .... Hemant Agarwal
