Writ petition

(Querist) 26 December 2017 This query is : Resolved
Respondent,s counsel accepted notice but never present before court. Counter affidavit not filed. Case pending for 5 years. Court not inclined to hearing case without presence/counter affidavit from respondent,s counsel. Pl. guide petitioner how to proceed further.
Ms.Usha Kapoor (Expert) 27 December 2017
YOUR Opposite party is any Public or G9vernment organization. Then only a Writ lies. You-pray the court for early disposal of case by proceeding exparte. as the Respondents are not attending the court hearings and not filed counter so far.Law protects the vigilant and not the intdolent .You say in your contention before court that the respondent has no other 9nterest in the case but indulge in procrastination tactics and waste court's time.

what your counsel's suggestion? file an urgent petition if you are a senior citizen then you can file on that stand too
P. Venu (Expert) 27 December 2017
Facts posted are insufficient to offer any meaningful suggestion. Anyhow, your advocate is the best guide in the matter.
Kumar Doab (Expert) 27 December 2017
The rules for early disposal of cases are available on HC website.

Pursue these.
