498a quashing

(Querist) 11 December 2017 This query is : Resolved
Respected Sir,i have filed quashing petition, 498a on settlement basis accordingly submitted affidavit , I would like to know that what will effect If complainant doesn't appear in high court then what will be effecte on my petition?
Vijay Raj Mahajan (Expert) 11 December 2017
If there is a compromise settlement between both parties and the quash petition is filled along with copy of the settlement and affidavit to that effect, the court notice is sent to the wife/complainant in S 498A FIR to appear and defend the petition.
If she doesn't appear being duly served with notice of the High Court, the Court in such cases being satisfied of compromise/settlement allows the quashing petition.

If the settlement took place privately between parties then court will seek the Complainant's presence.
