Acquittal on VAC case but still not appointed

(Querist) 09 September 2017 This query is : Resolved
My colleague Asst Ex. Engineer acquited in a corruption case from spl court. one year passed. But still he is not posted for the older post. What to do. Pl guide me
Sudhir Kumar, Advocate (Expert) 10 September 2017
vague query. give facts of the case.

If your firend is seeking a govt jopb he may not get it.

if you mean reinstatement after suspension/dismissal please state clearly.

if he wants re-posted on same post where he was alleged taking money he has no remedy.

so give facts instead of making it a riddle.
gopinathan (Querist) 10 September 2017
He was charged corruption of 10000 from a contractor. But it was not proved n aquitted by spl court.

Every thing depends whether it has acquittal on merits or on benefit of doubt. In the latter scenario, it is open to the Department to initiate disciplinary proceedings, if not already initiated. However, if the acquittal has been unqualified and if no disciplinary proceedings are pending, the concerned employee can approach the judicial forum after exhausting administrative remedies.
Rajendra K Goyal (Expert) 10 September 2017
Whether any disciplinary proceedings were initiated and decided?

If not, whether he reported the department with a request to allow his joining.

Sudhir Kumar, Advocate (Expert) 10 September 2017
Here the person is not disclosing whether he accused is acquitted on benefit of doubt or honourably or whether any disciplinary action is contemplated or not.

He is concerned with posting on the same desk where from money can be generated against and he has no remedy for the same.

I agree with expert Mr. Sudhir Kumar, incomplete information can not lead to form an opinion on the basis of permutation and combination.
Why did your friend not ask the question from his lawyer? How are you concerned with half-baked question?
Adv. Yogen Kakade Online (Expert) 11 September 2017
I agree with Mr. Sudhir Kumar.
