Power resting in hands of DM incase of petroleum NOC

In Application made to DM for petroleum NOC, municipal commissioner gave negative response saying said site has 952 sq.mtrs of land, and for petroleum NOC from their department it shud be atleast 1000 sq.mtrs., what are the powers of DM to still grant NOC for petroleum being essential product ?

The DM would by the provisions of law in this regard which has already been highlighted by the Tahsildar. Hence it is needless to explain further on this if you are trying to go by the legal process.
