Working hours

(Querist) 10 June 2017 This query is : Resolved 
Sir, I am working in a private company from last 7 years. Our law says that the working time should be 8 hours a day. But we have to work for 12 hours without any incentives. We are not getting any national and state holiday. Weather it is 26th January or 15 August. And in return we get nothing. I want to know, where and how to complain ? In our state everybody knows that what's happening in the industries. Even our industrial minister, labour commissioner and even chief minister. How we get justice ?

What is its nature of business say; IT, ITeS?


How many persons are employed in it?
What is your designation and nature of duties?



How many persons report to you?



Do you have any power to sanction leave/increment/appoint/terminate/appraise etc etc ?

You are in which state?
Since how many months you are working?
Do standing orders (model/certified) apply to establishment and your designation?






Are you a member of employee’s/trade unions?

--of attendance record

--of demand made to you to work for 12hrs/day

on off days

on holidays

I agree with expert Mr. Tiwari, you are required to initiate your claim through a local lawyer practicing in labour & service matters, if your story is true since no organisation/company/firm in India can call its employees on National Holidays.

If there is some union existing involve them.

An impulsive action by you (employees) that are ill informed, non united, can fetch penultimate action from attorney's of employer in Line Management/HR/Legal cells...................and employer.



Don't jump to agitate.

Avoid legal notice for the time being.
