Not getting salary from employers

Hi all,

i am ravindra sharma and working with roche diabets care in sales from last 5 year. from last 6 months company was not in profitable condition so they start cost cutting by removing their old employees whos packages is good and hire new employees with half of the packages.

i left company in 1 march 2017 and issues as below

1-i resign with 3 month notice period but they releive me on the spot.
2- company hold my febraury salary and commit that it will come with F&F but i have not received it with F&F.
3- company not paid my expences of last 2 months
4- company not paid my incentive

i have send mail so many times to HR, company Head etc but getting reply.

i have all the documantation of all above said lines.

What is this establishment; Commercial, Industrial?


What is its nature of business say; IT, ITeS?


How many persons are employed in it?
What is your designation and nature of duties?



How many persons report to you?



Do you have any power to sanction leave/increment/appoint/terminate/appraise etc etc ?

You are in which state?
Since how many months you are working?
Do standing orders (model/certified) apply to establishment and your designation?



Was ever any stinker, memo, show cause notice on any misconduct issued to you?


Are you a member of employee’s/trade unions?


What is your monthly salary?

Pls post the extract from appointment letter issued to you, termination/Resignation/Notice Period-pay............exit formalities.



Were you asked to handover the charge/assets and acknowledgment was issued to you?

If acceptance of resignation (with mention of immediate effect, salary slip of Feb, correct FnF statement, Form16 as per correct FnF statement, NOC/NDC, acknowledgment of 2 months expense statement, service certificate, relieving letter, PF a/c statement etc etc has been supplied to you.

sir i was working as senior sales executive in medical devise company in jalandhar ,punjab.

one show cause notice to me regarding fales claiming bills which i have replied to HR and it was a mistake of vendor.
the communication which i received from the vendor same i forward to hr (all are in mail)

later on they called me and ask to resign with immediate effect but i resign with 3 month notice period. but they releive me on the spot.

Issue legal notice through your lawyer followed by filing a case under section 33 of Industrial Disputes Act (if applicable in your case) otherwise file a suit for recovery.

sir i have shown, show cause notice to one of advocate who was very expert in labour law and he told me its very simple notice and you dont worry but if company will stop your salary , which means your case become strong because company is not authorised to stop salary without intiomate.

i have replied to show cause notice and where my vendor except that its his fault same thing i have forward to HR. which means i have not done any thing wrong.

later on company stop my feb month salary.i have call to fr and msg to hr regarding not getting salary.

on 1st march company called me office(mumbai) and force me to resign( advocate told me that on the behalf of show cause notice they will not terminate you).

i have resigned on 1st march with 3 month notice but company releive me on the same day.

now my salary(feb 17) is pending which is not even come with F&F.

TODAY I GOT A MAIL AND THEY TOLD ME MY INCENTIVE AND 2 MONTHS EXPENCES WILL NOT B PAID BECAUSE OF SUBMISSION OF DOCTORED TRAVEL BILL.

AND FOR FEB SALARY THEY WILL LET ME KNOW.

when company releived you same day company give you one month salary but here they have not paid this salary also

so finally
feb salary
march salary( notice period salary)
2 month expences
incentive

all are pending

kindly give a way to fight for my right.

Has the company supplied you FnF statement? Have you accepted it.

Who and what is fr?

What is the link of vendor's bill (even if doctored) with your tour and tour expenses and incentives?

If you have resigned on 1st March with notice period of 3 months, then why are you asking salary upto 17th Feb only.




If the notice period started from 1st March then along with salary of Feb, notice pay of 3 months is to be tendered to you.

You already have an 'advocate who was very expert in labour law'............


He must have examined all docs and advised you.


He might have also advised you to approach ALCC.
