Hi Sir ,
My father is ex-serviceman .during his servie he got second married having first wife alive.
When he got retired that time for pention application he pasted second wife's photograph with the first wifes name .
Now he is living with second wife .
Issue is that first wifes name is there on PPF and seconds sign and photo so we have to change it .
First wife want mentainance from her husband's pention
How she can get her mentainance
And want to lodge fir against ex-serviceman For Fake Documents provided to Records.

Please help me

Once you file a Complaint with his Dept he would Not Only Land in trouble there are Chances of Loosing his Pension it self for his Criminal Offence.Better with the help of Local Good Senior Advocate talk to the concerned Person and arrive at a remedy.Photo could be replaced with justifying reasons "Mistake " .Discuss with your Advocate

Consult the Local Good Advocate and Implement the necessary changes like Photograph Fraudulently/Wrongly submitted to be replaced.Only the First who is in Records of the Army only would be entitled for all the benefits.Implement it Soon and immediately.

The Ex. Army man is alive.
He has retired.

The pasting of photo of 2nd lady seems to be deliberate.

Insist to get it corrected, amicably or you may have to approach authorities.

It is felt that:for maintenance from pension you may have to approach the Civil Court or the jurisdictional Criminal Court under appropriate laws.

Discuss with local counsel of unshakable repute and integrity at your location well versed with Army service rules.

1. When did your father retire, which arm/service, what was his rank when he retired?

2. Whether your father's second marriage is endorsed in his service dossier/records or concealed? Whether the second wife's name appear in his "discharge book"?

3. First (Original) lady is the only person entitled for "family pension" after the death of ESM despite the fact photograph might have been pasted in his record as stated by you, which is prima facie unbelievable story.

4. During life time of pensioner he is liable to maintain his first/original wife along with her minor children as per Army Pension Rules but not second/duplicate, if any. In case the pensioner is not maintaining his first wife, she should approach Armed Forces Tribunal of jurisdiction or area Magistrate or both.

5. Discuss with a prudent local lawyer practicing in service (Military) cases.

16 maratha li infantry Records Belgaum rank was Hav .
2)second wifes name not recorded in his office .he only pasted her photo and signature as first wifes .
3) original lady is ilitrate that's why he taken unwanted benifit
So please how and where we should apply for mentainance form pention

Meet the Concerned Dept's Pension office.First Discuss with your father thro your Advocate for an amicable terms failing which tell him that Complaint would be the remedy.
