Bail in 326

arrested in a false case of 307 in which later got bailed . but then police added more sections 326 in the CHARGESHEET along with the 307. Now if we appear in court . will we need to go jail again for bail or. Bail can be granted on the basis that we were bailed in 307. Though there is no medical available with police neither 307 or 326 will be applicable at the later stage. Kindly help

Any how, when you appear in the court on receipt of summons, bail needs to be taken. Your advocate will guide you in the matter.

Discuss with your lawyer in detail, he is well aware of the case file an the bail orders.

Once you have already been enlarged on bail under a crime number of the FIR, you need not again obtain bail for the same fir, consult your lawyer.

The problem is we consult 2-3lawyers everyone says different things...

One says that bail will be given on basis of that we r bailed out in 307

Other one says we need same day orders from high Court else we will b sent to jail again..

I would like to add one more thing if the CHARGESHEET is filed in court ... is it possible for police to bring back the CHARGESHEET for further investigation or put some stay on the CHARGESHEET meanwhile the further investigation goes on.
