cctv wiring being cut by the neighbourer

I have installed cctv outside my home to view visitor movements of common staircase after taking permission from the society. My neighbourer on the reason of encroachment of privacy has objected to instllation of cctv citing reasoning as why i should see who is coming and going from his home. My main door and his main door are opening in common staircase and are abutting . On two occasions his son has cut the cctv wire passing from staircase to make cctv non functional.i have video footage for the same. Can i make a criminal case against him and file FIR against him with police if yes under what act.Police had earlier on my complaint had filed NC . Is this causing damage to cctv by cutting wire of it to make it non functional covered under cyber crime. What charges can be made against him. Is providing cctv in staircase legally permissable which is common space. Kindly advice.

A staircase is a common area. Installation of a CCTV requires the common consent of all the occupants.

Moreover, a CCTV is no substitute for a good neighbour.

What are the need of CCTV, whether it is a gated society having guard? If yes, try to reconsider the installation of CCTV if neighbors does not like.

The neighbor could also object to society than resorting to cutting the wires.


Society could have resolved.


You can complain to society and/or police and/or arrive at amicable conclusion as well.


A good neighbor is an asset.

The society cannot allow such illegal action, if allowed it is void. You may install camera in your house and not in "common area" accessible for all residents (including your neighbour).
Besides this, it (your house) is not a single house of the society. However, society may install CCTV for security/ surveillance in entire society with the consent of all members.
Sort out the matter amicably, it does not involve any legal advise. If you are dissatisfied, lodge a police complaint after consulting a local prudent lawyer.
