Remedies available to consumer - judgement not passed

(Querist) 22 March 2016 This query is : Resolved
Learned Members,

I had filed a case in Karnataka State Consumer Disputes Redressal Commission Bangalore. My case was admitted in January 2012. After a long wait of 4 years, the case was disposed in the first week of January 2016. On the case list in the court, it is mentioned that it is partly allowed. The judgement was not pronounced in the court.

Till date (even after a lapse of 2.5 months) I have not received the Judgement order. When I check with the Bench Clerk, I am informed that the judgement is not yet passed and signed.

What are the remedies available to be to ensure that I get the judgement order.

Can I file a case in the same court against them for deficiency of service.

Thanking you in anticipation

u cannot file any case against court.

wait for order to be passed by court.

you seek a hearing on your own motion in the same court.
dr g balakrishnan (Expert) 22 March 2016
problem today is most advocates really do not know procedure; many advocates take advocacy as a pass time hobby just because they have an LL.B or a B.L degree that is attracious.

if just to work with bench clerk why you need an advocate better fight yr matter yourself as there is no of any advocate if it is your own case, in every court up to supreme court of india

you meet the president of the forum or the state tribunal where the matter is filed. tks

Learned Members,

I am not an advocate. The case in the Karnataka State Consumer Disputes Redressal Commission Bangalore was argued by an Advocate. Since I have not received the Judgement order, I am seeing if there is any remedy

No case of deficiency of service lies agaisnt consumer forum though apparently negligence is there.
You can bring this lethargy or negligence of forum in not passing judgement even after 2.5 months to the Principal Secretary, Consumer Affairs Department, Chairman of National Consumer Disputed Commission.

sorry, if yr advocate told you to wait you can even move on him under deficiency of service, every professional faces deficiency of service, means none can cheat any consumer of any services.

see in mumbai and suburbs like navi mumbai some advertise for data entry work for housewives, senior citizens, then once they approach they say you have to pay registration fees in thousands, that is also falling under deficiency of services as registration does not exceed rs.100,- more even universities moved against under deficiency of services after all indian over all population avg is not earning more than $,100.- permonth.

so never show any sympathies for day light robbers, you can move upto hon supreme court if national commission fails to redress , it is not failing invariably.

you have yr right under art 13 is still invokable under art 14 r/w art 226, for directions , to governments in place.
dr g balakrishnan (Expert) 22 March 2016
u can comment on advocates if that community is failing as professionals.
dr g balakrishnan (Expert) 22 March 2016
u can even move against the advocate before bar councils and even against bar councils if the councils are partial they can be moved against; any way advocates must desist irrational working , that kind work happens if he is ill qualified of ethics and morals; all cannot become lawyers to practice at court just because by wearing black robes his intellect cannot overnight zooms as a great advocate unless he or she works very hard, not hardly.

Bar shd be having self discipline if not better resign and work as some law assistant in some companies or real estates or as panel lawyers, you cannot work for ordinary people when they need relief from govt inappropriate action against poor people.

constitution s for majority people not for selected groups of well to do only.

why advocacy is required governments failed very badly these days misusing police as their politicians privates. so poor people question therefore constitution is for all people.
