Husband forcing to leave job otherwise wants divorce

My sister has been working in a public sector bank since last 2 years. She got married 2 months ago. Soon after marriage she was kept like a prisoner at in-laws home (no movement outside the room without permission; even for toilet). She came back to her matenal home after 1 month where she is working . Her husband now starts forcing her to take tranfer/leave job at once or he will file divorce. Even mother-in-law abuses her on phone and takes sides with her son. Is the husband justified in claiming divorce ? Can the wife file case against husband and in-laws under domestic violence act ?

Mam,

Merely asking to leave a job is no ground for domestic violence, but yes they are abusing then it can be a ground for the domestic violence... Since the marriage is just 2 months old so it is advisable not to approach court and give time to each other....

It is not advisable to leave the job. She can apply for transfer.

Try to have amicable solution with the help of elders, relatives, society people.

What a hypothetical situation you have created through your query, when you said, "no movement outside the room without permission; EVEN FOR TOILET"!

Do you want to say, she was using the room as her toilet also?

Even if there is even a slight truth, why not she apply for the divorce, instead of her husband? Better she seeks divorce than to spend life of a prisnor.

Take help of a competent Lawyer, if transfer can save marriage, relationships of your sister, she can opt for it. Leaving job is not advisable. In case, things are not working, file DV Act complaint along with other remedies available. You need not to move Divorce petition first.

To clarify.....she had to give missed call to sister-in-law whenever she had to go toilet....sister-in-law would come and take her to toilet door....she had to stay in a single room without any ventilation....food used to given in her room 3 times a day...even her clothes used to be kept outside the room....everytime she had to call someone to give her clothes.....isn't it like a life of a prisoner....when she talked to husband about this he said that this was his family's custom - a newly wed is supposed to be kept like this.....besides she had to face insults from mother-in-law.....can all this be treated as 'domestic violence' ?...Thanks for all the advice.

It would not be easy to divorce till all parties agree as contested divorce may take years. It may ruin peaceful life of both.

Sister in law is enjoying all facilities, it appears from you post. The position may not remain such in the comming month or so. Try to save the marriage.

Divorce through Mutual consent can be filed after one year.
