Labor law dual employment

I resigned from my 1st employer, i tendered one day notice on 1st april 2014, and joined 2nd employer on 15th april 2014, few weeks later requested for full and final settlement with 1st employer, i received statement that shows last working day 4th april 2014 , i paid all debts and eventually i received experience cum relieving letter with date of relieving as 30th april 2014
Now on paper from 15th till 30 th april i am under dual employment which is practically not possible
Please advice how to resolve this as my new employer may not accept it.

Have not you discussed with the previous employer, why he showed last working day as 4th april and not relieved you on expiry of the notice period? If not any specific reason, and if yes, what was his reply?

Forget all the dates. If you are not facing any problem with the existing ( 2nd employer) why you should go in depth. It is irrelevant at this stage.

The discrepancies are to be pointed out by you to the previous employer and ask for correction.


Do you have proof of FnF payouts made by you and acknowledgment by employer?


Pursue with employer HR/appointing authority/MD and get the variance corrected and obtain revised FnF statement.

And yes i have cleared all dues and facing problem with my third employer, my offer with 3rd employer is on hold on grounds of dual employment, now confusion is...i didnt serve notice and employer is giving letter with date of relieving as if i have completed notice period, in fact i have joined 2nd company during the said notice period on paper, so is it actually dual employment or not
