Married man can live without divorce in live in relationship

(Querist) 28 February 2016 This query is : Resolved
Dear experts,
My father is living permanently with a lady after the death of my mother.now I came to know the fact that my father is in relationship with that lady before the death of my mother and he has a daughter too with that relationship.I got a copy of voter ID of both lady and her daughter, using my father name as her husband and father. I have full education details of daughter through RTI in which my father name is used as a father. Is this sufficient to register case for bigamy.please suggest me what can I do better legally.I will be really thankful to all of you .
Regards , vikas,

If the documents shows or if there are witnesses to testify that he was in relationship before you mother's death, a complaint of bigamy can be filed. But it is also to be verified whether your father validly married this lady or not.

your mother if alive could have filed a case of bigamy if at all there was marriage and there was proof of the same.

You can not file case of bigamy against your father in the given situation.
Devajyoti Barman (Expert) 28 February 2016
Yes, this is enough but there will be no point in doing this as your mother is no more.
Reconcile with the fate and accept him as he is.
Filing of case will not earn you any peace.

Mr. Vikas,

Where is bigamy, except your corrupted mind against your own father?

To be frank, I don't see in your story anything else other than an academic query of yours.

However, if there is even a slightest truth in your story, I can guess that only you and your family would have been responsible in creating compulsion for your father to live with some other family in his old debilitating age.

So, instead of doing anything legally, it will be better for you if you try relook the envorinments prevailing in your own household and the attitude adopted by you or your family towards him to help you find reason, why your father was compelled to leave you to live with some other family after the death of your mother. I am sure, you will definitely find fault with you or your wife or children, whose attitudes would have compelled him to go to live with some other family. Otherwise, no parent would prefer to leave his own family in his/her old age, particularly of his own son on whom he sustains full hope of providing comfortable livelihood in his/ her old age of infirmity.

Just think if you have forgotten your own responsibility towards your father in his old age, who brought you up, rather than taking any legal action. Your father would definitely have sought mental peace with the family life of the other lady after leaving you and your family.

So instead of you thinking of taking any legal action against him or the lady for bigamy, your father has got full legal right to take action against you for neglecting him in his old age.
