Jurisdiction of suit against lic of india

(Querist) 23 December 2015 This query is : Resolved
i am working as an insurance agent in LIC of India.
Now some issue has crept up regarding not issuing my commission amount to me.
Now, the Head office is in Mumbai and i am living in Delhi and posted in Delhi Branch.
Shall i have to visit Mumbai court to file suit against the company?
Pl suggest whether i have to file recovery case or criminal case and in which state??
SURESH BV, Advocate (Expert) 23 December 2015
Dear Rajesh Kumar,

Issue a Legal Notice and then file a civil suit for recovery at Delhi itself.
Rajendra K Goyal (Expert) 24 December 2015
Can be filed in Delhi till terms of appointment specifically mention to file at Mumbai.
Sudhir Kumar, Advocate (Expert) 24 December 2015
where did the cause of action arise.
Kumar Doab (Expert) 24 December 2015
The policy would have been underwritten and issued from your branch with which you are attached.

The commission is paid from branch with which you are attached.

Escalate the evidence to Chairman's cell and also involve LIC agents' unions/Trade unions.

Your issue is likely to be resolved.

Has the jurisdictional courts been stated in agency agreement?
Devajyoti Barman (Expert) 25 December 2015
You can very well file the case in New Delhi; I wonder what is the reason of your confusion when there is no ambiguity as afar as jurisdiction of court is concerned.
K.S.Srinivas (Expert) 29 December 2015
As mentioned in the agreement.
rajesh kumar (Querist) 29 December 2015
In Agent-Employee agreement, it is written that all disputes will be settled in Mumbai Court as the Head office of LIC is in Mumbai.
T. Kalaiselvan, Advocate (Expert) 03 January 2016
You can file a suit in Delhi itself, the jurisdiction clause what you mention may not be applicable to your case.
