Division of ancestral property

(Querist) 12 April 2015 This query is : Resolved
My father received 10 acres of land from my grandfather 33 years back, he sold all of it, there upon he also received Rs.92 lacs after the demise of my grand father 6 years ago, I am 50 years old and have two children aged 18 and 14 respectively, I also have a sister who is a widow. Please let me know what would be my and my children's rights in this matter as my father and me do not have to good a relationship and he is threatening to go to court for settlement. My father refuses to give me anything, keeps giving false promises but actually does nothing. Although he has helped financially in bits and pieces at times.

It will depend upon the following facts:

(1) how did your grand father got the property - whether he purchased it or he got it from his father?

(2) if he got it from his father, in which year he got it?

(3)if he got it from his father, how did his father (i.e. your great grand father got the land?)

Without knowing this detail, it is not at all possible to give answer to your query.

My grand father got it from his father, who got it as compensation against the land they owned in Pakistan before partition. What happened before that I have no idea. Kindly help

There is no reason to believe this to be ancestral property thereby you may not have any claim or share in it. However you may consult a local advocate and get his opinion by showing the relevant papers to him.
Dr J C Vashista (Expert) 19 April 2015
Contact and consult a local lawyer with all documents qua property.
