Get it acquitted by making the defacto complainant as hostile witness and tendering an application about out of court compromise before the trial court, which would help to dispose the case as desired.

SeC.323 IPC is non-cognizable and compoundable offense hence, can be settled amicably. Whereas,Sec.376 IPC is cognizable, non-bailable and non-compoundable offense triable by a Sessions Judge so compromise or quash is not possible.
